1. Acceptance of Terms

By visiting our website or requesting a site consultation, you agree to comply with and be bound by these Terms & Conditions, our Privacy Policy, and any other legal notices posted on this website. If you do not agree to these terms, please discontinue use of our website and services immediately.

2. Definition of Services

Byron Pool Boxes provides bespoke design, measurement, soundproofing, and on-site carpentry construction services for custom pool pump boxes and outdoor storage boxes for pool equipment. We service residential and commercial properties within a flexible 50-kilometre radius of Byron Bay, New South Wales.

3. On-Site Consultations, Estimates, and Quotes

Initial Assessments: Initial on-site consultations, environmental assessments, and measurements are provided free of charge at our absolute discretion.

Validity of Quotes: All written quotes provided following an on-site visit are valid for thirty (30) days from the date of issue unless stated otherwise in writing.

Site Preparation: Standard ground preparation and basic leveling are included in our standard quotes. Complex site requirements—including but not limited to pouring concrete slabs, extensive slope excavation, or structural retaining—will be explicitly detailed as extra line-item costs within the final written quote.

Fixed Pricing: Final contract pricing is confirmed only upon a signed or written acceptance of the quote by the Client.

4. Client Obligations & Site Access

Access Requirements: The Client must provide safe, clear, and unobstructed access to the pool equipment area on the agreed installation dates. This includes ensuring pets are secured and children are kept away from the construction zone.

Validity of Quotes: All written quotes provided following an on-site visit are valid for thirty (30) days from the date of issue unless stated otherwise in writing.

Utility Utilities & Hidden Obstacles: The Client must inform Byron Pool Boxes of any known hidden hazards, underground pipes, electrical cables, or structural vulnerabilities near the build site prior to commencement. While we take maximum care, we accept no liability for damage to unidentified or incorrectly marked underground services.

Approvals: The Client is solely responsible for ensuring that any custom enclosure ordered complies with their specific strata bylaws, community titles, or tenancy agreements.

5. Timelines & Fulfillment

The 3-Week Target: We aim to complete construction within twenty-one (21) days from written quote approval, subject to material availability.

Delays: Byron Pool Boxes is not liable for project delays resulting from circumstances beyond our reasonable control, including but not limited to severe weather events, supply chain shortages, or restricted site access.

6. Australian Consumer Law & Guarantees

Statutory Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Remedies: For major failures with the service, you are entitled to cancel your service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.

Exclusions: Standard timber weathering, natural timber colour variations, grain movement, surface checking, and minor warping due to external environmental exposure (such as UV rays and coastal salt air) are natural characteristics of hardwood (Spotted Gum, Blackbutt, Tallowwood, Ironbark, Red Gum, Merbau) and are not considered manufacturing or structural defects.

7. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law, Byron Pool Boxes, its owners, and operators shall not be liable for:

Any direct, indirect, incidental, or consequential damages resulting from your use of this website.

The temporary unavailability of the website due to technical maintenance or third-party hosting failures.

Inaccuracies, errors, or omissions in the information published on this website.

Equipment overheating or damage resulting from a Client modifying, blocking, or tampering with the built-in, noise-reducing overlapping ventilation system.

8. Use of Website & Intellectual Property

All custom text, custom imagery, graphics, digital assets, and logos displayed on this website are the intellectual property of Byron Pool Boxes (or its licensors).

You agree to use this website solely for lawful purposes, such as researching services and booking site consultations.

You must not copy, reproduce, scrape, or redistribute any content from this site without our express prior written consent.

9. External Third-Party Links

Our website or eventual blog posts (“Articles”) may include links to third-party web pages (such as local council pages or material suppliers). Byron Pool Boxes does not endorse, control, or accept responsibility for the content, privacy practices, or security of any external websites.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by, and construed in accordance with, the laws of New South Wales, Australia. Any legal disputes or claims arising from the use of our website or services shall be subject to the exclusive jurisdiction of the courts of New South Wales.
